Employer deducting salary protection premium, but not paying it over

Hi desparate,

It would seem that your employer is making a deduction from your salary, but not passing it on to the service provider (Cornmarket).

This may well be a breach of the 1991 Payment of Wages Act. You may wish to make a complaint to the Workplace Relations Commission, who may be willing to send an Inspector into your employer. This in turn could lead to a "Compliance Notice" being issued to your employer.

It's not an illegal deduction of salary - it's an illegal retention of funds that do not belong to the organisation
But by retaining the funds, it becomes an illegal deduction, and a breach of the payment of wages act. A complaint can be made to the WRC on this basis.
 
The employer is funded by the HSE. So presumably if they close the HSE will have to take up their role directly. St John Of God successfully called the HSE's lack of funding bluff a few weeks ago. The money tree magically provided.

Yesterday discovered they are behind with our pension payments!!! No pension paid into our funds this year to date. Last payment was 22/01/24 for December.
 
The Pensions Act requires an employer to pay over pension deduction within 21 days of the end of the month the money was deducted.

 
You need to get onto the WRC to send an inspector immediately. They are deducting monies from your salary for legitimate reasons but not paying those bodies. This will impact you and not your company. If they cannot afford to pay staff they need to start laying them off. Especially the CFO and the CEO who are making these financial decision. If the company is not a going concern it needs to be wound up, paying staff and creditors.

And if the company is a charity, then get onto the charity regulator about monies not being accounted for and the pensions regulator about non payment of pensions money.

And have you all as a group spoken to senior management?

Yes the HSe is main source, it is a charity. I’m 30yrs in my job and there are a lot of long term staff. Spoke before Xmas to senior management but nothing since ….no communication is the most difficult …honesty will always win respect even if we don’t like the message.

That's a bit harsh...the poster is being proactive in terms of monitoring what's happening. Please take that on board before you say they have blinkers on.

And you think they are all good reasons to sit & wait it out?

I don't see any signs of employees being 'proactive'.

Spoke to "senior management" 3 months ago & nothing since; the OP has "no intention of job hunting".

You or I only know so much. We know nothing of the OP's situation (mortgage, outgoings etc.) or their prospects of getting similar work or work that pays the same.
Maybe you are spot on with your posts but people will make decisions at their own pace. They are still getting paid so things are (presently) not a total disaster.
What is shocking to me is a government funded entity can jeopardise the livelihoods of so many 3rd parties just because its a total basket case for over spends. Something should be done to address the over spends, much of which is not at the coal face, rather in ineffective administration.
