I know of someone who used Woods & Co. of Aran Quay and were very pleased with the outcome.

Memory fades.

I think most solicitors will have experience in this field as this has become an all too often issue. It is important however he knows a barrister who has experience in this area.
I would suggest that you put everything down on paper now as a persons memory can fade. Get details of your work colleagues phone numbers and addresses as you may need to call on them in the future. If attending any meetings bring along a tape recorder, get hold of previous appraisals etc. At a time like this you may feel that you have done something wrong so try and remember when you were asked to speak at functions, participate in staff outings, worked your days off, overtime and generally were a decent and helpful staff member. Keep all your payslips, p60's, appointment letters, terms and conditions of employment etc

Can you be dismissed without warning for sending an email which was deemed to be offensive?

Does the company have a policy around email usage? If so, what does the policy say about sanctions for abuse?

I'm not quite sure. I guess I could find out. I don't think it does or if it does I don't think it was made known to my the person in question. Do you have to be given a warning first?

Good HR practice would suggest that such a policy is in place and is notified to all staff as part of the induction process. Has the employee been in place for > 12 months? Was the email sent internally or externally? What was the nature of the offensive content?

to dismiss on the basis of conduct, the conduct must generally be of such a serious or continuing nature as to amount to serious misconduct.

a one off act, and where the employer fails to give a warning, is not usually seen to amount to serious misconduct. but it depends how serious that one of act is.

as a matter of interest, your dismissal is assumed to be an unfair one and the burden of proof is on your employer to show that it was a fair dismissal.

bottom line, get yourself some advice.
