I will be a taking over as a director of our OMC hopefully soon. The company has not been run for the last 2 years since the agent upped and left and even when they were in place they were cowboys.

As a result the members register is not fully representative of the current state of play. There is a mix of residential houses, commercial and apartments.

There will be gaps we can fill in just from people we know and knocking on doors may yield results, or internet searches. But, where to go after that?

Estate agents where properties are rented out, but what about where banks have repossessed or a property has sat vacant for a long time? How do you find out what bank owns it? I am aware of the land registry, do banks move to update that when they reposses?

What if a person has moved abroad?

Any and all advice appreciated.
 
I don't understand how this can be the situation. Members register is the list of all owners. Properties cannot be sold without paperwork from the management company so there has to be a paper trail.

A list of whether units are owner occupied or rented not being up to date fair enough, but the owners list should legally be accurate.
 
OP, From reading your post a number of times, I think if you intend to do the job of running the Management Company by yourself, you're on a hiding to nothing. There must be other owners that have some capability to assist you.
There are so many issues to contend with !! Is there any Insurance in place ??

If there are no other owners to help, walk away gracefully and without my being rude and your PPR is there, consider selling up and moving before the entire collapses around you.
 
@mercman - Not going it alone! There is typically a legal requirement to have at least 2 directors at all times. This can be increased through ordinary resolutions or by the current directors. We have 3 to 5 bodies interested currently.

I dont believe that we are at the point where the whole thing will come crashing down. It can be turned around.

@shesells. We are confused as well as to how this has happened. We know that the agent tried to charge new owners for the fees of old owners when they were in place! No one has received a share certificate.

The directors had zero involvement as they were the ceo's of a large building company which has since gone bust.

I can understand though how someone can just move away and rent out their property and no one would know about it.

What paperwork does the OMC handle with the sale of a property?
