I not seeing a wrong- just a misfortune. The state scheme does not necessarily provide a floor of rights. It’s just a scheme to be applied when nothing else is present. The alternative scheme doesn’t necessarily have to have all the provisions of the state scheme as a basis.

If the company’s scheme is superior, they can disregard the state scheme. @messyleo has explained why your son is likely to lose out in these circumstances.

It’s not a coincidence that big companies design sick leave schemes to achieve these outcomes.

Your son is entitled to an explanation as to why the state scheme doesn’t apply. Assuming he gets one, I don’t think it’s in his best long term interests to shout the odds in terms of what the company should and shouldn’t be doing - certainly not in the first 12 months when the company is still free to dispense with his services.
