Hi,

I've a query about the procedure for raising a claim through the small claims district courts.
If it is raised against a business name and not the actual limited company that owns the business is it still a valid claim?

Could the business have a judgment against it even though its just a 'trading as' name and not the company itself?

My reading of the procedure is that you must raise it against either an individual (in the case of a sole trader), or a limited company.
I just cant work out if its enough to just make the claim against a shops name and address. The procedure stresses that the name and address are critical but doesn't really differentiate between business name and company name.


Would someone be able to advise?
