Rent Allowance Query and tax liability

I've put up a thread before about this so I'll quickly outline.My sister has been living with me for the past 2 years.She lost her job last year and so received unemployment benefit.I had never asked her to pay rent so there was no record of such.I have discovered that she has been receiving rent supplement
of 46 euro/week for the past year.

Basically what I want to find out is;

a)How did she receive RA without me signing any forms eg SWA 3 etc.

b)Have the HSE forwarded any of my details to Revenue as I have been

told that they are obliged by law to do this.As I am not a landlord,I have

never had to declare any rental income as I don't rent out rooms.

Also,If I contact the HSE/CWO,will they confirm that they are they are

making payments to my sister and can I explain that I'm unaware of the

situation and am concerned about any tax implications for myself.

Any advise would be greatly appreciated.
 
sounds like your sister has some explaining to do.....
Given that you live there it would come under rent-a-room scheme anyway so I wouldn't be worried about prtb or Revenue.
I reckon if you got on to HSE your sister might be in a lot of trouble, consider carefully if that's what you want or whether you should just talk to the sister.

If you didn't sign an SWA3 (Rent Supplement application form) but the CWO received one, which they would need to begin the claim process, then it was signed by someone else.

Yes, it is a legal requirement for the HSE to pass on to Revenue details of Rent Supplement paid along with the landlord details supplied on the SWA3. So it's likely that your details (if they were entered on the SWA3 form) have been recorded and sent on for 2009.

Since late 2008, landlords have been asked to supply their PPSNs - this was done by way of separate letter, sent directly to the landlord following the award of the Rent Supplement claim. If your name & address was supplied as the landlord details, then a letter was issued to you.

The HSE could not give you details of another person's claim (even if it is family, and you are involved, albeit without your knowledge). You could write to the CWO (or to the Superintendent CWO) to advise them that you are not a landlord and have never signed any SWA3 forms in respect of the rented address. This would start an investigation into the claim.
