Property Ownership Transfer

Looking for advise, Live in Dublin Ireland. My partner and i separated 2 years ago and he left the country . We have had no communication since. We have a house with both our names , he agreed to transfer the ownership . But he has gone missing , how do I transfer the property to my name when he isn't responding to the anyone (me and the lawyer).
What does the law state if he is missing ..... how long can i wait till i can have the property transferred.
 
What has your solicitor advised?

Is there a mortgage on the property or is it owned outright?

There may be some useful information in existing threads related to this topic?

 
His Lawyer is waiting for a response from him, basically no advise on next steps.
Property has a mortgage and im paying for it.
Trying to understand what would be next steps if someone never response to this situation.

My solicitor is waiting on response from his lawyer. Its a waiting game at this point.
Just wanted to know how long will the law allow if he does not respond.
 
You need to get your own solicitor to advise you. If they're not doing or responding to your communications then maybe you need a different one?
 
Devils advocate here; but I suspect at this point its more work than is worthwhile for Solicitor.

So first things first, were you married & do you have children?
 
There is no fixed time after which you get to transfer the house into your name.

If he continues to refuse to engage, at some point you issue court proceedings. You'll have difficulty serving them on him and you'll probably have to get the court to give you permission to, e.g, serve them on the solicitor he used to instruct, serve them on a family member of his, serve them by publishing them in the paper; something like that. Then, you ask the court to order the property to be transferred to you. Odd are that at some point he probably will engage with the court proceedings and oppose what you are seeking — you say he agreed to transfer the ownership, but his behaviour since then suggests that he may have changed his mind. If you and he can't agree on a financial settlement then the court will impose one, which may or may not include transferring the house to you.
