Planning Permission for Velux window

Am in the process of buting an old second hand house in Cork city centre. The currents owners have installed a velux window in the attic for the attic conversion, they claim the put it in before planning permission was required for this. I plan to resell the hosue in the future, is it neccessary to apply for planning permission for this velux window??? thanks

Yes, Velux windows may require planning permission and you need to get copies of planning applications and approvals before you proceed. You will of course employ a suitably qualified person to do a full structural and planning survey on the house, won't you?

yes i've done th structural survey and this came up in the report. the sellars claim it was installed before you need planning permission for such a development though.How can i prove this?

You don't have to prove this, the vendor does. Ask politely for dates etc. and make discreet enquiries with the local planning office. Your QS can be of help here.

I meant to say ask about dates, installer, architect and who they spoke to in the planning office and documented proof of exemption from planning at the time, then make discreet enquiries with the local planning office. Your QS can be of help here.

You don't say if the velux is to the front, back or side. AFAIK velux windows to the back do not need planning permission.

There is no planning required if the attic conversion was done with velux at the back. If velux was at the front or dormer type attic conversion then planning is required unless built before 1964. Is it possible that it is that old? you would be wise however to ask for an Engineers Certificate to confirm that the property did not require planning and is structurly sound. Ask your solicitor to request this from the Vendor.

The window does not seem to be a legal problem with your purchase going through, as your solictor would have informed you, why do you think it would now be a problem?. I can only assume the window is to the back.

Mags (under different user name) the velux is at the front of the house actually. the sale has fallen thro anyway as i requested that they apply for planning and i hold back some money from the sale until it goes thro. the sellars refused to do so, so i bailed out.

If there were existing velux's in the front from when the house was built and velux's are now being placed at the back would this be also exemt from needing planning?
