No you can't! Returns under warranty would only be entertained for faulty goods.
it would be faulty if it is not as described. it has to be reasonably accurate or is not as described. i now know it should be accurate to+/- 3 degrees c
 
But you don't know what % RH accuracy it is supposed to be: it could be +/- 10%. For temp. you mentioned +/- 3C. Well it's certainly not accurate by most standards but it's all relative. E.g. If it reads 17C and 55%, but in reality it may be 14C and 65% would you be happy with that?

If it performs worse than it's stated accuracy (RH or temperature) how are you going to know anyway - how can you demonstrate or prove it?

No, some units are supplied with a cert. of conformance or better, certs. of calibration - but you'll pay more for this.

I was told +/- 3C overall not just for temp

Doesn't make sense though. Humidity accuracy is expressed as a percentage.
