Nissan Double Take Offer.

Well,

I say "horses for courses", You like pink, I like red and green....
and if thats the offer then Nissan should stand by it. End of Story.

I think that is a little unfair. I would imagine that the apparently generous terms of this offer probably had a lot to do with his son taking up the offer and buying a Nissan in the first place(and not some other make), now that the garage has got the cash they are seemingly unwilling to give him the car that he wants, not the car that the garage wants to give him and that you all think is best. If he wants a sunroof then he should be given a car with a sunroof, especially as those were the terms of the deal. I mean it's a terribly simple request, a car with a sunroof not a/c, is it really that difficult for the garage to deliver? Indeed I would go so far as to say that it is the garage and not the son that is being difficult.
 
But what if they offered front fogs or something instead -- wouldn't be quite the same then. Chances the T's&C's have a '' if exact same is not available ....................equal or greater value'' bit in there somewhere.

I, like probably 90% of people never properly read the T&C properly and this is what usually comes about(when I have tried, some vague or legal speak part usually goes over my head anyway!)
 
gramlab is right,
ask them to show you where substitution is allowed in the t's & c's, if they can well then that's what was signed up to.
If they can't, badger them away and depending on your persistence and value on your own time, either get as many extras thrown in as possible (through dealer first, then nissan ireland) or persist via court for a breach of contract and full refund.

they seem to be your options.

He's not getting a brand new car for free.. he paid for it in 2005 as part of the offer. And if he was promised the exact same car then that's what he should get unless he agrees to accept the compromise.

Maybe he's thinking about the fuel cost when the air conditioning is on?
 
Having a sunroof open would likely cost the same in fuel terms (due to increased drag) as having the ac turned on

I'm sorry but they guy is most definitely getting the car for free and is benefiting too. Ithink the word 'free' was even in the original ads!!! AFAIK, when purchasing the Nissan in 2005, he did not have to pay any more for the car, therefore the 2006 version is a new free car. He also benefits from resetting the clock of his initial cash outlay in terms of depreciation. If he bought a Toyota, Renault or whatever he would still 'only' have a 2005 car, no free 2006 version.

There's no such thing as a free lunch, he had to pay the full retail price for the car whereas he would have been able to negociate a significant (thousands) cash discount otherwise.

Why do you imagine Nissan made this offer? Generosity?
 
The double take is a decent offer, kinda. Basically this is how it works:

Benefits:

1) New car now, new car next year.
2) Trade your old car in this year when its worth more.
3) Benefit from model changes next year which are usually positives.eg the new micra is alot nicer than the old one and in 2007 there will be a new almera.
4) Pick a new colour next year.

Negatives:

1) You loose your Straight Purchase Discount (1,000 to 2,000ish depending on model). IE pay full list price when not trading in. Or if trading in you get the "trade value" of the car which is what a trader outside the garage will give for the car or what the garage will stand it at before preping it for resale(newer cars only)
2) The car is limited to 12,000 miles or 18,000km. A surplus of 10 or 15 cent is charged per additional mile. You can't expect to clock up 50,000 and hand it back.

As for the poster who's son wanted to still have a sunroof in his 2006 model which now came with A/C instead. The dealer would no way have given you a 05 Reg car. He could only have been offering older unregistered stock which would still be registered as a spanking new car.

Average mileage in a petrol is 12,000 miles, so if you do that or less its a good deal. Also you don't have to keep the car for a full year. So if you do a double take in may 06. You can get your new car in Jan 07 provided you are not on finance in which case your payments lock you into keeping car 1 for 12 months.

The real benefit is, take the micra for example; you can trade up one year at a real cost of 1,000 Euro Extra to you with the double take, whereas it would cost 2,750 to 3,000 to go up one year without this deal.

If it was a "new free car", then surely he'd be allowed to keep the one he paid for in full???
