Did your father get a figure for the cost of probate?
I honestly don't know

What proof do you have of the submission to the probate office?
Again I don't know, probably just the solicitor's word on it.
Did that aunt have an issue with the sibling left out of the will?
Not that I know of, I don't think the family are suspecting anything untoward on her part.
 
Is there any reason why a solicitor who took instructions and prepared a will would refuse to provide an affidavit of testamentary capacity, would it be unusual for them to do that and can they be forced to provide one?
 
I'm just enquiring @DannyBoyD I don't know the system at all. I think it's crazy that someone would have to go to all the expense of the high court when it would appear there's a much simpler solution.
 
I think you've had a lot of good feedback here already in particular around your father renouncing the executor role.

Let someone else have the stress.
 
Regardless of who is executor it just appears to be unnecessary expense to me , a few posters on here have described it as the nuclear option, why let it get to that stage?

Is your Dad and his siblings happy with the ruling? Any idea of the costs to the estate?
 
My father wasn't bothered either way, he just wanted the whole thing brought to a conclusion. No idea of final costs. I heard one of the siblings wasn't happy because going with the older will means the deceased brother will be included and his daughter will now get an equal share of the estate.

Thanks for the update Superfan. How is your Dad’s health? Hope he is keeping well. After all the costs, fair deal and solicitors & barristers are paid there will be little to share 8 ways or 7 ways.
 
Another update, not sure when the new probate application was submitted but we're still waiting on it being finalized, 2 and a half years at this stage. I attended a meeting with my father and the solicitors earlier this year and I asked for a ballpark final figure including court proceedings and they said 20k. My father was shocked at this and they said it may be less, I suggested it could also end up being higher and they agreed.
My father got a letter last week and the current bill stands at 34k.
