Firing your solicitor

We have recruited a solicitor to recoup monies owed by a company in difficulties.

So basically time is of the essence.

However our case is not a priority for this solicitor and we have had difficulty contacting him and getting him to contact the debtor in a logical and timely fashion. I suspect he is a good solicitor who has taken on too many clients.

So we have reached the point where we want to fire this guy.

So what should we pay him for, given that he has not done the job he was recruited for which was agree a contract for repaying the €€€ or take it to the high court for a what-ever-you-call-it.

His behaviour is making us look foolish and unprofessional to the other side and the longer we delay the more likely the company goes to the wall.

In summary: How to fire and what to pay?

Schedule a meeting with him and discuss your concerns and ask how much his fee is to date.

Why not drop him a fax tomorrow morning referring to the matter and mentioning 'that whilst you required him to act on your behalf concerning the matter, it appears that the matters have gone unabated. We therefore would be obliged if you could disregard our instructions with immediate effect. Whilst we are unaware of any works done in this regard, please forward a detailed fee note by return which will be investigated without any unforeseen delay. Yours etc' or similar

Have tried ringing and emailing. we are not in ireland so a meeting is difficult. He did send us an apology email before Christmas and claimed to have come in over Christmas to deal with his backlog (not ours obviously)

Merc my OH just sent off one to that effect.
