Honohan - "No. If you can get past the Circuit Court, some of the judges in the High Court are ok. However, some of them are still stuck with the old notion that if you borrow money you should pay it back."

I used to handle all the mortgage cases. But then they switched it to Circuit Court for family homes. They have a tendency to operate on a factory line basis. Own motion of assessment with EU law is not done. The Circuit Courts ask "What is that?" because we have an adversarial system in Irish.

Irish judges just don't get involved.

But the Supreme Court has hinted that they would like some issues to come before them.

But borrowers don't have the resources to go to the Supreme Court.

Presumably Ed genuinely believes that the judiciary should apply the literal meaning of the phrase "the never never" to every debtor!

One thing I did learn, which I had not known was that the adversarial system in Ireland and the UK is not the system in Europe.
I knew it was "investigatory" ? in France, but I had thought that was an outlier.

I have to say though that from watching possession cases in the Circuit Court, the Registrar looked for reasons not to grant an order. If it had been purely adversarial, there would have been a lot more orders granted as the borrower was often not there.
