My ex wife and i split up four years ago and she stayed in the marital home and carried on with the payments. 2 years after her new partner moved in and they continued to live there. In the recent divorce absolute the county judge stated that my ex wife would be responsible for any shortfall in the sale of the house with the mortgage company and with also the second charge. She has now informed me that the house is now being repossessed as she and her new partner have a new house. The mortgage company want us both to sign for a voluntary repossession. Should i sign this? and does the divorce stating that she is liable for the shortfall still stand??
