Constructive Dismissal?

I'm looking for some advice on my sister's behalf. She works in the insurance sector. Her role is head of a dept. reporting to a group head (one layer between her and Director) . Recently the whole department has been restructured and she has been told that although her working title and conditions remain the same, a new level has been created so that she now reports down two levels from the top instead of one. She doesnt think this is victimisation however she feels, although it is unwarrented, that it is a reflection of her working ability. Up until now she has no indication that this might be the case ie excellent performance reviews, full bonus paid since she went into the role 3 years ago.. Question is could she claim constuctive dismissal?

Thanks for any advice on what she should do?

Hi Aries

I would guess that a company has a right to restructure itself from time to time. From what you have described, the only thing which has changed is that a new level of management has been inserted above her. This might not be good for her ego, but it's hardly constructive dismissal.

If she is not happy with it, she should talk to her boss and maybe to a few colleagues in similar positions.

The jobs market is flying at the moment and she will have no problem getting a job elsewhere as she has such good reviews.
