I would like to have an advice on this.
Do I have a chance in court if the father is on unemployment benefit?I do know he has some extra money coming in.

You might give some more specific details of your case, if might lead to more and better answers. Are you getting any money at present? I would imagine if you are getting nothing you should be able to get something in Court..

Also, check Courts.ie they have reports on family law cases, I put in the link below...In regard to income, I would assume your childs father would have to produce a statement of means in Court. While you might think he has more income can you actually prove it?

Well,at the moment it is a fight every week will he give or will he say -sorry can't.
He was in court with me 5 years ago,then it was an agreement between us at the end .
After a while he left the country,and court cudnt help,because it was agreement between two of us.
Now he's back ,not very happy that I ask at all.He did say that he will give 50 a week,but as I said it takes me begin for it week to week.And there is weeks that I cant get anything.
Im on lone parents with 2 kids,back to college ,cant even afford childcare.
The main thing here is that he'll vanish again,and I'll wont be able to do anything about it.Thats why I would like the court to make pay .
 
If he is on JB he has the same income (officially) as you have apart from the E29 x2 for the kids. Therefore I see no reason why he should not be obliged to pay his share towards maintenance of the children.

Any money you get should be paid through a bank so that there is a record (proof of payment or non payment)

Sorry to hear of your plight, I think you need a proper legal agreement. then if he skips the country you can pursue him through Central Maintenance recovery Section in the Dept. of Justice. Under an International Convention they can pursue him in other countries for outstanding maintenance.
