Can I Get My Deposit Back

i payed out 800 euros to attend a course 9 weeks ago the the course is not due to start untill mid feb, . i informed the course that i could'nt attend the course due to work commitment 6 weeks ago they have only got back to me last night saying i could.nt have my money back . i was not informed when handing over my deposit it would be retained by them. the course director seems to be constantly out of the country when i ring . at no stage did i sign a contract to agree to this and i feel i gave them enough notice to fill the place on the course (6 weeks) i have also given them the option of transfering the 800 on to my sisters account who is attending another course to no avail, iv tried the consumer affairs but their very reserved in their advice can any one with a similar problem give me a direction to go in and resolve this . thanks for all and any help
 
Write to them asking for your deposit back or a written explanation as to why this is not possible. See what happens. If necessary pursue this to the Small Claims Court.
 
i think small claims court may be my only option ,
 
Presumably you had to register for the course initially. What did the terms and conditions of that registration say with regard to refunds?
 
i registered on my lunch break , no forms or terms and conditions , just lazer card for the fee, also no mention of the deposit not being refunded even with plenty of notice,
 
Did you do this online? Are you absolutely sure that the booking form did not have something about terms & conditions with clicking through the booking process indicating acceptance whether or not you read them. Can you post the link to the site perhaps?

In the meantime you should familiarise yourself with their terms and conditions either on their web site or brochures. Forewarned is forearmed :) Best of luck.

In fairness to them, I think there is a duty on consumers to check the terms & conditions relating to any deposit. I'm somewhat amazed at how many consumers seem to assume that they can get deposits back if they like - that kind-of defeats the purpose of a deposit.
 
I would suggest you check the small print. And whatever you do, pursue it.

I once paid €5,000 for a course which i cancelled according to their policies and the training company refused to honor a refund. Luckily i was able to point them to a copy of the terms and conditions on their website which i had downloaded in pdf format which they could not refute.

They're all unscrupulous messers just in it for a quick buck.

Make sure you challenge it.
 
it is the duty of all honest business traders to give the full details when offering a service and not hide or try to put one over people, the laws on deposits in this country are extremly open to interpetation.
 
I have challenged the collage and pointed out i would have been prepared to go to the small claims court, according to ther terms and conditions which i read after the fact , they should not have considered me for the course unless i signed and agreed to the terms and conditions , on this one i have won they returned my deposit i full today. thanks for all your help on this one , but lesson learned never hand over a deposit unless all terms are agreed by both parties and watch out for these unscrupulous people who feel they have a right to rip us off.
