Hi All

A mate of mine was attending a 40th birthday party at a local pub. During the night a gurrier gatecrashed and starting acting the b*****ks. He was promptly ejected by the family attending the party. The gurrier left the property but came back some hours later and started driving like a lunatic around the pub's carpark and eventually collided with my mate's car, causing substantial damage.

I had a brief look at the Occupiers Liability Act but am unsure as to whether my mate can sue the pub owner for the damage?
 
does the pub car park have a sign saying no responsibilty to property etc? most of them do. but i don't know if that stands up in court or not.
 
Why should he sue to pub owner? Why not pursue the person actually responsible for causing the damage?
 
Yes, the usual sign was displayed in the carpark and the Gurrier is untraceable.
 
Damage to property from an untraced driver/vehicle unfortunately does not come within the remit of MIBI- only if there is an injury.
