Annual leave after Sick leave?

Hi!
I've been on sick leave for just over 12 months (unfortunately as a result of a serious car crash). I am hoping to return to work in the next 6 weeks. I have a permanent position working for the Government. Am I entitled to annual leave, which I would have been entitled to otherwise, if I had not been out sick?

While everyone is entitled to annual leave, the period within which it may be taken needs to be agreed withthe employer i.e. you can't just take off on holidays when you feel like it without clearing with your employer first.

If your employer is agreeable to your taking annual leave immediately after sick leave, there is nothing to stop you. You may however, require a note from your doctor confirming specifically that you are fit to resume work i.e. establishing the point at which your sick leave terminated.
