Hi there,

I had a baby last year and returned to work in February this year after taking 6 months paid, 4 months unpaid and 7 weeks parents leave.

Myself and the hubby are jointly assessed both of us on salaries of 51k approx each.

My wages have been fluctuating alot since I went back to work and have never stabilized, when I look at both incomes, his income threshold at 20% I'd 51k and he has just gone over it in his Nov paycheck. Mine however is 31k at 20% remaining amount is 40% My gross income is 43k, am I right in thinking I am due a refund?

As you haven't said how much tax you have both paid, it is not possible to answer your question

Are you assessed jointly or separately?

Try plugging your respective annual incomes for 2024 and other details into a tax calculator such as this to get an idea of what your respective total annual deductions are likely to be.

If you somehow end up paying the wrong amount of tax/PRSI/USC then you can correct and rebalance things via your Revenue myAccount.

You are still being taxed on a 'Week 1' basis most likely? Contact Revenue and tell them you are no longer in receipt of maternity pay and would like to revert to 'cumulative' basis of taxation.

Explanation of taxation when you are in receipt of a DSP payment

Sounds like the SRCOP (Standard Rate Cut-off Point) is allocated so that he gets €51K and you get the €33K increase for a married/civil partnership couple (it was €31K in 2023).
Married or in a civil partnership (both spouses or civil partners with income)€51,000 @ 20% (with an increase of 33,000 max), balance @ 40%
If you log into your Revenue myAccount you should be able to see how your SRCOP is allocated and if your credits are correct etc.

If you want further assistance from others here then you'll almost certainly need to post more specific details/figures - e.g. the monthly and cumulative figures from both of your most recent payslips.
