AIB AIB next steps

The good people at BDO note our case is still receiving attention as of today. I expect there must be a requirement to update people at a regular intervals but it seems a bit unnecessary, we have lost track of the months the same letter arrives, or very slightly amended wording. It is just a bit of a waste of postage really, I feel like I should reply at this stage to say thanks for the updates.

This all feels very empty given all the tragedy in the world right now but hopefully there might be closure this year sometime.

Is there any update on this? The 35 day for appeal to the High Court has surely passed. It all seems to have gone very quiet.
 
Hi Brendan, we received 1st letter from FSPO on 24th Feb, and 2nd reminder today. I had followed your advice right to the end and used all your templates including final one which I sent last October. Is anyone else getting these letters from FSPO? Advice needed please!

I think you should reply as follows

"Yes, we do wish to proceed with the complaint.

But I understand from an announcement that AIB made that you have made a preliminary decision in another case and that they are waiting to see whether you will confirm that decision or not.

Under the circumstances, I would ask you to put this case on hold until AIB makes a further announcement in that case. "
 
Hi All,
Please see attached, this is my third or fourth reply from BDO since the news a few weeks back same letter different dates , has anyone got this type of letter ? Not sure where I stand now I haven’t received a rejection either ?

That is very strange

They just sent you half a letter? And then they sent it to you twice? And they were both printed at a 90 degrees angle. Weird.

Basically the same content in 3 or 4 letters ‘’ my appeal is still receiving attention and is currently with the panel as it continues its deliberations ‘’

The Appeals Panel has been superseded by the decision of the Ombudsman.

You can ignore them completely.

If AIB announces a redress programme based on the Ombudsman decision, the Appeals Panel might become relevant again to assess disputes over the implementation of any redress programme.

My own view on this would be that the existing Appeals Panel should be stood down and replaced by a new one.

Surely as FSPO decision is only a preliminary decision he should keep going with his!

Good point.

So just to be clear:

I am not suggesting that anyone should withdraw their appeal to the Independent Appeals Panel
But neither should they get excited about the repeated letters saying that they need more time to consider the appeal.

It is unlikely that the Appeals Panel is going to uphold any appeals on the Prevailing Rate issue. They have rejected them all so far.

But they do have a role on other issues e.g. the amount of redress and compensation where AIB has acknowledged that the person should be put back on a tracker.

If AIB announces a prevailing rate redress scheme, the Appeals Panel may continue to be used so it will be useful to have your appeal at the top of the queue.
 
Hi Brendan, I replied by email to the letter I received from FSPO. They emailed back to say I still have to fill out the complaint form. Looking for advice again with the form because I don't want to fill it in incorrectly. Has anyone else filled in this form?

It's badly worded. But this is how I read it.

I note that you wish to put your complaint on hold, and so we have put it on hold.

If you later want to revive your complaint,
we will require a completed complaint form.

Anyway, there is no need for you to respond to this letter or fill in the form.

I suspect that AIB is in discussion with the Central Bank. I have no inside knowledge to that effect, but that is what I assume is happening.

If I am wrong and AIB do not announce a redress scheme, or if they announce one which you don't accept, then you can wake up your FSPO complaint.

If they announce a redress scheme with which you are happy, then you should write to the FSPO accordingly.

In early February we announced that we had made an additional provision, primarily in relation to an FSPO decision on an individual case relating to a tracker complaint which was then at a preliminary stage. This case is now concluded with the FSPO. While this case involved a number of complex issues the Bank has decided to accept the finding in full, and to apply the finding to other customers within the same cohort. Customers do not need to take any action and will receive a letter and their payments in July and August.

Sounds like they have begrudgingly conceded defeat and the end is in sight. Congratulations everyone.

True enough, not a sign of an apology from AIB nor an acknowledgement of all the unnecessary hardship they have caused this cohort of mortgage holders
