In effect it could be months before we know if AIB are paying us redress and how much?
Thanks Brendan. Unfortunately we’re in a temporary renting situation - We were sale agreed last November and it fell through so we’re on borrowed time!
I think mid April was the date given where we could have some certainty as AIB had something like 7 days to respond to the preliminary decision, then 30 or so to appeal to the High Court.
Hi BrendanThat is not correct. There is no set date. It could be before that and it could be after that.
For example, there might be a lot of exchanges of comment on the preliminary decision. After the exchanges are finished, the Ombudsman could take some time to issue his final decision. If neither side appeals that decision, it could take the Ombudsman a long time to publish that decision. Note that he made many final decisions last year, none of which he has published yet. So it's at least 6 months in some cases since the final decision issued.
And, even if he does publish it, so what? That is just that decision and has no formal legal significance for anyone else.
The only way you will know if you are getting some offer of redress is if and when 1) AIB announces some scheme of redress and 2) you get a letter offering you that redress.
This could happen in the coming weeks or it might not happen for 6 months. As I have said many times, I genuinely don't know.

has AIB an issue with the activity of the tracker panel in light of the preliminary decision of the Ombudsman?
I was told by BDO approx. 10 days ago that the AIB Tracker Panel are not making anymore decisions on Clause 3.2 cases until they get further clarification of the Ombudsman decision.I don't think so.
The Panel is not making awards on this issue so they won't be compromising anytyhing that AIB might do.
The Appeals Panel is independent and is continuing to reject appeals on this issue with the same letter.

Is the 35 days that aib had to appeal the ombudsman's decision up this week??.. I imagine the whole process may be delayed given the current crises but was wondering if anyone had an idea if a timeline at this stage??
I thought I read on another thread that the final decision was expected in March?? Probably unlikely for months now
