Advice needed regarding non-contributory pension and means that were not declared by my deceased mother

I have a state pension non contributary problem, my mother recently passed away and has been claiming this pension but has not declared means, is there a solution for this situation
 
Your mother's executor/administrator should 'fess up to the DSP and make an arrnagement to calculate the overpayment and repay it out of your mother's estate. The first duty of the administrator/executor is to pay the deceased's debts, and this is one of them.

(Plus, if they are proactive about disclosing this rather than waiting for the DSP to approach them, they may be able to negotiate a slightly better repayment deal.)
 
What’s a slightly better repayment deal?

I would have thought either the assets of the estate cover the shortfall or they don’t.
Well, Tom says there's no scope for a better deal since interest is normally not charged anyway, and I bow to his superior knowledge. What I had in mind was an abatement of interest (not a runner, obviously) or penalties (probably also not relevant), or an allowance of additional time to settle the liablity (which may not be of much interest anyway.
 
If there are others whose inheritance will be reduced I would not make an early voluntary disclosure, wait for the DSP to ask. It will happen as part of the normal process. Otherwise you will be blamed forever.
 
Is there a solicitor advising on the probate process? If so then what have they advised with regard to this matter?
