Accident query

They dont want to be involved unless i'm making a claim from them and I certainly dont want to have to claim from my own insurance I really feel strongly about this I think my daughter has been mugged and this is why I'm so angry
 
First off the injuries board is not the place to go.
You need to go to Financial Services Ombudsman.

Before that if you dispute the pre accident value you will need to get a number of quotes from garages for a replacement car.
Provide them with the millage on your car and a accurate description of the condition.
You can also use websites like Carzone to back up your argument
Unless the mileage was very high and the condition of the car was poor you should be able to push for a bit more money
 
As she was driving to work at the time of the incident - if she suffered an injury as a result of this accident - for the purposes of social welfare this is also considered to be an occupational injury. Her entitlements are as follows, injury benefit, she can apply for disablement benefit which is awarded on a percentage basis, and medical care. Under medical care, she is entitled to full refund of all GP fees, all prescription fees, public a/e charges, public inpatient fees, all travel expenses incurred to and from doctors and prescribed centres of treatment. You are also entitled to a full refund of all services that are not met under the Health Acts - which includes private psychological or counselling fees.
 
Certain things increase and decrease the value of the vehicle. Having more than 12 months NCT left on the vehicle, provable service history, higher spec models etc.

You are in no way obliged to accept the sum offered by the other partys insurer. There is ALWAYS room for negotiation.

It is true that the value of vehicles has severely decreased in the past 12-18 months. This is due in part to the motor tax/VRT changes and in part to the recession. Another poster suggested looking on carzone or similar website for a similar vehicle - this is a good way to support your arguement for the sum offered being increased. Not knowing the engine size, mileage or spec of the vehicle makes it difficult to give a better idea of what your daughter should be seeking. PM me if you like
