are we legally obliged to have our car nct and if we dont can we be legally proscuted

a) Depends on how old your car is

When you try to renew your tax you must provide the NCT cert (if after the 3 year registered date) and if you dont provide this you cannot get the Tax Certificate.

However you are able to prove that the car is booked in rather than having passed. Eventually, or on the 2nd annivesary after the 3 years they will mostly likely refuse to renew your tax without.

Also, the Gardai have no authority to police the NCT and only check for Tax & Insurance.

Wrong , this requirement was removed a few years back during the nct strike...you can tax without nct now , just leave the section on the form blank.

As per NCT FAQ ([broken link removed])

15. How will car testing be enforced?
Enforcement is the responsibility of the Garda Siochana. All eligible cars must display an NCT Disc on car windscreens, which will instantly identify those cars that have passed the test.
