Making a will

We(dh & I) want to make a will - it is probably complicated as there is a stepchild involved, lands in a foreign country and a personal injury award when one of the children reaches 18.

I have used 2 other solicitors for different matters and have not beeen impressed by either. Any recommendations - don't want it to cost a fortune either as we don't have it but we need to get our act together just in case!

Was the personal injury case in the name of the child (and you suing as next friend)? If this is the case then the child gets the award when s/he is 18 and you would have no control over it under your will. You can appoint a testamentary guardian for children under 18 in your will.

You should shop around in advance. A will is usually value for money when considering its importance.

Yes Personal Injury claim was in child's name with me as next friend. Just think 18 is too young for him to get a lump sum - can I do anything to move it to 21?

Excuse my ignorance but what is a testamentary guardian?

My main concern is that my child's natural father (not DH with whom I have 2 other children) will have a claim to anything belonging to my child/other children and want to safeguard against this.

A testamentary guardian is a guardian appointed under will. You can nominate who you wish to have care of the child if something was to happen to you.

Your son is entitled to the settlement at 18 but an application must be done to the court for it to be released to him. If the application wasn't done then the court will not release it.
