Objection to shed - complaint confidential?

Hi all,
my in-laws received a visit from a planning officer (Co. Kerry), regarding a newly built shed they had constructed on their land. It is under the requirements for planning permission.

Apparently a neighbour objected. Does anyone know if they are entitled to find out who this was? I rang the planning office in Tralee but they are very slow to return my call / answer my query.

I can fully appreciate that there may well be prodecures in place to protect those that lodge complaints but was unable to find any information, including from their website.

Any advice or direction appreciated, thanks.
 
I'm presuming it may be the same in Kerry, however the person I spoke to was quite unsure. There's no huge problem at all with the objection - that is a given right to all. It just hits a nerve slightly asit is a very small rural area and my father in-law is disabled - the shed was built knowingly by all as a greenhouse to keep him occupied and help in his rehabilitation.
 
Why are you so concerned about who complained?

Was their complaint valid?

Do you have an authorised development?

I think it would be more 'contructive' to actual deal with the required planning issue about your shed- do you need to apply for planning retention?

Good cause but building (non exempt) buildings without permission is not on.
 
AFAIK they are not entitled to find out who objected. The council protect the confidentiality of objectors.

AFAIK not even a FOI request can release this information, but i may be erroneous on that one.
 
under foi the body of the complaint may be released i.e the letter but the name and adress or any other identifing information would be exempt from the letter

As stated in my original post, the shed is exempt from PP as it does not exceed the size regulation.

LOLL - thanks for the info regarding about the letter and blanked details under the FOI act. I presumed (and understand) why this would be the case. Many thanks.

this is probably a case where there is already outbuildings. Thus, the floor area of these existing outbuildings, taken together with this subject building, cannot excede 25 sq m.

You simply cant keep building 25 sq m sheds and say each of them is exempt.

The planning officer came to the house, explained the complaint that had been made and that he was obliged to inspect. Measured the shed etc. He certified that it was absolutely fine and no planning permission was (a) initially required and (b) nor was rentention necessary to be applied for.

I'm a little confused as to where you got the idea that we were planning for rentention?!

oh, i beg your pardon....

I thought when you stated that it was 'under the requirements for planning' that it required planning. Sorry.... misinterpretation.

If the case is that you dont need planning then i really would simply draw two lines under the whole situation and forget about it. Rubbing salt in the wounds wont serve any purpose.
 
Sorry for confusion - I am glad no problem exist.

In any case, I'm sure Planning Officers receive complaints/ queries on a daily basis from neighbours etc re. developments. Under the Planning Acts, they are obliged to investigate same- this is what appears to have taken place here.

Apologies again to original poster- I should read more carefully in future!
