All Commercials @ 5% bik?

Can I assume that any new vehicle bought from a Main Dealer that is advertised & sold as a commercial from the showroom is a valid commercial for 5% bik?

I am looking at a Freelander 2 Commercial but obviously don't want to find out retrospectively that it's not, since it's more in the SUV market rather than say a Landcruiser?
 
For BIK purposes a vehicle attracts the 5% rate for tax if it is a van. For these purposes a van is:

- designed or constructed solely or mainly for the carriage of goods
- has a roofed area or areas to the rear of the driver's seat
- has no side windows or seating fittined in that froofed area
- has a gross vehicle weight not exceeding 3,500kg.

So, if this vehicle has rear window or rear seats, it is not a van for BIK purposes and will be subject to BIK as a car.
 
I think the Revenue.ie website is pretty specific about vehicle calsifications from what I can remember.

Basically, if the vehicle has no back seats/windows and is being sold as a commercial then you 'should' be ok.

There is no back seats, the floor level in the back is raised and carpeted. The Rear door windows are also carpeted up. This is probably the standard conversion for all other commercials etc...

I suppose a call to the Revenue would sort it out for definite.

A bit off the point but if a bank loan was used to purchase the van/commercial. Do you get the vat back in one go or periodically over time as you submit bi-monthly vat returns.

You can claim the vat back in one go, just make sure to get a vat invoice from the garage.
 
Is the 5% BIK charged on the total cost including VAT or excluding VAT of the van’s new price?
