Appying for PP while owning a house in a different county

Hi,

My uncle has agreed to sell us a site in Co. Wexford. He has also agreed to sell my sister a neighbouring site. We currently live and work in the west of Ireland, however we want to move back to my home county and be near to my parents who live approx 10 miles from the site.

Can we apply for full planning permission while still living and owning a home in another county? We intend to sell as soon as we get planning and move in with my parents until the house is built. We're afraid to sell now and then apply in case we don't get the planning.

I don't think Wexford Co Co are as strict on proving a "local need" as other Co Councils seem to be. What are our chances of getting planning before selling and moving?

yes you can....

and there is a specific mention of returning emmigrants in the 'Sustainable Rural Housing Guidelines'....... you do not need to sell or move before you make your application.....
 
Earlier this year we applied for PP for a site on my mothers land in Westmeath. At the time we had been living in clonmel for over 10 years in our own house. As I was originally from the area the local need was satisfied, however I would advise you to do the following
  • Get a good draughtsman/architest in Wexford who is familiar with the house designs that the council are likely to grant PP. Planners like to see plans from people they know
  • Get a letter from your uncle stating that it would be of great benefit to have you living locally pull a few heart strings if you what I mean
  • Get a letter from your local GAA/soccer club supporting your application
  • If you have kids registar them in the local school and get a letter from the school stating this
  • Once application has been submitted give your local TD/councillor a ring/letter and let them know about your application. If there is a problem withdraw the application before the grant date as you do not want a refusal against the site
  • Be prepared for further information e.g type of treatment system for waste water,

I'm a bit worried about satisfying the local need bit, or Rural Linkage as it's called in the Wexford Development Plan. I didn't grow up in the area of the site. I grew up about 10 miles away in the nearest town, however my Dad grew up on the farm that my uncle inherited. We do intend to send our children to the local school and my only sibling intends to build on the adjacent site. We have another uncle living in the same lane.

Regarding the actual drawing of the plans - my husband is proficient in AutoCad and has done several house plans in the past, all of which got planning permission albeit in different counties. We intend to do the plans ourselves and get them signed off by an Engineer and in the process save ourselves a couple of thousand euro. Is this a gamble I wonder?
 
The rule in waterford was that you have to have been living within seven miles of the proposed site and that you if you satisfied that you could not have been living in the town or village and move out to the countryside.

As my partner is a nurse we got a letter from a local doctor that she was moving closer to home to mind her parents in their old age, i also got a letter from work stating that i would be working on sites through out munster.

I know pre planning meetings can be of very little help but if your husband had outline plans for what you wish to build before putting too much work in to it, the planners should put him straight as to what they do and dont like check their website and houses in the surrounding area.

I have heard that this local need thing is now no longer an issue. Some european court ruling recently. I stand corrected but it might be no harm to logon to gov.ie and see is this requirement no now longer binding
 
rahman... any chance of a link???

from my understanding the EU ruling is to be made on foot of a complaint that the rural guidelines are too restrictive..... personally i cannot see them being overturned, if anything they will be made stricter (ie farmers and primary industry employment only).....
 
I cant provide a link but it was Definitely overturned for that woman up in Roscommon i dont know if that case will now take Precedence or not.

My advice to you is this, invest in a good architect, spend the money on that. We got planning permission first go because when we went for the pre planning meeting the planner said, "at last, someone has designed a house to suit a site and local area and not just said I want this house on this site". They said you wouldnt believe what people do instead of concentrating on the design of the house. I went to the pre planning meeting with my architect and every question or query the planner asked, he answered. We had hardly any conditions on the house just a few on the entrance. Also the local councellor offered to go to the pre planning meeting with us and the architect wouldnt allow it, said he would prefer to work off his own merit. We were in another county too moving back home.

To the best of my knowledge (if the local need thing isn't an issue) anyone can apply for PP on any plot of land as long as they have the permission of the actual owners.

I dont think moving from the west of Ireland would class anyone as a returned emigrant :)

In any event the OP needs to read the Rural Housing conditions of the Wexford County Development Plan. Each county has its own requirements and what may be acceptable in another county or what was acceptable in Wexford 5 years ago has no relevance to the present plan.
 
quite correct nutty nut.... i misread the OP as 'country' and and not 'county'...

but it needs to be understood that what the EU did is not a 'ruling' as has been misconstrued by journos.... its a request for information.....

I am originally from and grew up in Butlerstown area and I am about to kickstart the whole planning process for a 3/4 acre site, about 1 mile from where I grew up. I currently own a house in Waterford City where I live. Based on your first sentence above and experience do you forsee problems for me when trying to get planning ?
