I got a precast floor done by a company. In the process of the job a wall was knocked down. Their was also several other problems. In short it was a mess by the end of it. They have sent an invoice. It caused a lot of stress, hassle and money to fix the job up on my own part.

What i want to know is "what are my options"

1- Substract the cost i have spent on fixing the job from the invoice.
2- Take them to court? Grounds would be a bad job done, stress etc ??
3- Pay them in full. (Which i do not want to do given they have not done the job correctly)

What are my consumer rights on this issue? Forget it, pay them and wash my hands of it?

Any help appreciated
 
Personally speaking,

Presuming you can prove the damage was caused by the said contractor, I would put together a letter advising the contractor of the damage caused; include a picture of the damage if you have one, get your builder or whomever to draw up an invoice for the work required to repair the damage caused send it off and negotiate it from there. Inform him that you will only be paying the value of the invoice less the damaged caused, might be worth contacting the engineer overseeing the build to get him to weigh in behind you also.

Thanks jollyman, i have taken several digital photos of the mistakes made onsite, and have them in my records. I had to get an engineer out (at an extra charge), also to get props, a teleporter etc. I have added all this up and subtracted it from the final invoice. But what of the delay and the hassle it caused to me.

Yeah i do have a contract, signed etc. Its the precast company that i brought the precast off that did the job... It was subbed or anything.
 
It will also depend on how your contract was worded.
Was the build suitable for the precast slabs - ie. were your blocks laid correctly prior to installation of slabs? Were there any unforeseen conditions which occured? Did the subbie in question know what conditions to expect once he arrived on site? etc etc

As long as your contract is detailed enough...and you can see no fault to be attributed to yourself and that it would appear that the fault is with your subbie, then list the remedial measures you had to undertake. It would be best to get this backed up by a professional engineer as well.
 
you wont have a hope of getting anything else of the subbie. Has he agreed the remedial and extra costs incurred due to the damage? I think you would be lucky to get all these cost back of him. What are the basis of the extra expenses ( the delay and hassle, good luck trying to price hassle!) I really think it could bring you more hassle trying to get any more out of them.
