Fence damaged by neighbours tree

Neighbours tree is damaging my fence and is growing into my garden. Its got so bad you cannot see the fence at the back of the garden. Can i make my neighbour sort out the tree on his property and also sort out hte damaged fence.
 
I'm not an expert but I do believe there is something in law about trespass by trees.

With regard to the garden fence would this not be considered 50:50 ownership between both property owners.

Not sure of your relationship with your neighbour but usually best to try sort these things out in a 'friendly' manner but if you need the number for a good solicitor let me know and I'll pm you.

Your entitled to cut back any branches or roots that are growing in or into your property. You must however give these back to your neighbour.

Have a care though if you set out to cut branches or roots, for both your own personal safety and in the case of roots because of the danger of weakening the tree's 'grip' such that it's in danger of falling. An opinion from a tree surgeon might be useful if you think that extensive cutting is required.
 
thanks for the replies will have a chat with the neighbour who is a nice guy and have always had a good relationship with his and his family.Problem is he is only renting and probally dose not care have said it already to him and asked him to tell his landlord dont think that the landlord cares to much and want to spend as little as possible
