My SIL has died. She took her own life due to severe psychological & financial abuse by her husband. He is now a lone parent of two small children. He has stopped his wife's mother and immediate family from even seeing the children. My question is if he died tomorrow would his wife's family be able to take care of the children or who would automatically be responsible for them?
 
If his will doesn't appoint a guardian/custodian for the children then others may be able to apply to court to be appointed:

Although this is not the question you asked, the children's grandparents can seek visitation rights.
Their grandmother is currently going through court to get visitation rights with her grandchildren. It is a very slow process as the hearings keep being adjourned, judge not turning up, her son in law not showing up etc. It's breaking her heart as she hasn't seen them now in almost 3 years. She's been fighting for visitation since around 3 months after her daughter's death. It's so evil to be the reason someone takes their own life, forcing her to leave her children with him ultimately and then tell her family that the children are his and they won't be seeing them anymore. They are part of her daughter, all she has left to hold close to her heart and she's missing precious time with them.
