new percolation test vs old percolation test

hi all,

I am resubmitting planning for an extension to a cottage and would appreciate some advice.
The planning was submitted and granted in 2008 and it passed the percolation tests under the old rules...
i.e. the p values were around 45.

The problem now is that the p-value has increased to around 60 (even though we have tested in the summer this time as opposed to the winter in 2008) and also the t-value is dodgy. The t-value does vary with hole location but in a couple of places adjacent to the proposed percolation area it is above 90.

The next door neighbours built in 2009 under the old regs and have treatment system with percolation area next (<10m) to my proposed percolation area. There is a line of large trees between percolation areas.

The questions i have are as follows:
can the runoff from the neighbour's percolation area be causing saturated soil in my proposed percolation area? If so, what can i do about it?

finally, we are in cork coco, and i suppose there is no comeback to them if we cannot pass the new regs? i.e. we got planning before but never built?

It's not their fault the original planning wasn't acted upon within the time limit. You're now on a new application, old data will not be relevant.
