Bank held back 5k of mortgage for repairs: no party wall in attic

Hi all
When purchasing my small house, the surveryor included lots of small potential repairs but highlighted that there was no party wall to one side of the house and so the bank held onto 5k of the mortgage until such work was done. The roof (no felt membrane, original tiles on 100 year old house) and windows could do with upgrading which I am happy to do though no yet essential, however the party wall will cost in the region of 5k with no chance of the neighbour (a commercial premises) contributing and so I will not be installing it for the neighbour's benefit.
Can the bank insist on a party wall being built and request certified proof ? I have house insurance through a broker so no issues for them in this regard. PTSB are not responding to my emails when requesting details of the return of my 5k.

This must have been a pre-condition of the loan approval as the bank could not retrospectively retain 5k of the mortgage amount without you been advised of this in advance of the sale closure.

Just so you're aware, most will not allow claims for burglary where there are no signs of a forceful entry. Open access, especially from a commercial premises that many people may have access to isn't a good idea.
