in a recent court appearance listing means assesment, the person in question living on jsa was ordered to pay 25 euro p/w off debt of 800 euro. he offered 15 p/.w which was declined. it is now back in court on mon next 17/09/2012. he is again willing to expidite the debt at 200p/m over 4 months..will the judge impose custodial order or accept that he wants to discharge his debt..as he is not refusing or denying the debt ?
 
25 per week for someone on JSA is crazy.

Normally judges will decline to make any order where the only income is SW.

No judge would commit someone to prison where he is making offers to settle.
 
thank you for your response thread, the judge did indeed make an order for 25 euro from jsa..the client offered 15 p/w. which was declined..every time he attempted to contact his debtors solicitor..he was busy or said write in to him ?.. now his last opportunity is to ask the court tomorrow to accept 200 euro p/m over 4 months to pay off the debt ? ..my own impression to him was i didnt think the courts would refuse..as he is not refusing or denying the debt ? but im no expert so i told him would enquire here, as someone may know the implications ?

I'm a little confused, if he can't afford 25 p/w how will he afford 200 p/m?
 
thank you both savvy / jim2007..i have put that question to fred and been told although the debt is hisalone his wife works p/t. and is lending him the 200p/m to clear off the debt quickly..its that or stick to the 15 euro p/w and face the prospect of custodial sentence foe 800 euro ? seems insane to me, but im just the messenger. yet others walk away owing millions ??
