Uninsured driver - damage to property

I need some help trying to figure out what are my options here:

An uninsured driver (on learner permit driving without L plate) slammed into my house damaging the front portion, few bricks gone and the inside wall is shifted few inches (approximate cost 2000 euros), Garda were called who took notice of the incident.

I have logged a request with Mibi and was talking to my home insurance firm who quite bluntly said that any claims would go against my policy which would increase my policy premium and also I have an excess policy of 1000 on my home insurance.

Any idea's what are my options here?

As far as I'am aware MIBI will only pay out for personal injury and not for damage to your car or property.

[FONT=&quot]It is not always possible to claim compensation for vehicle or property damage under the MIBI compensation scheme. Where the offending vehicle is not identified there is no provision in the 1988 or the 2004 MIBI Agreements to recover losses for vehicle or property damage. The 2009 MIBI Agreement (Clause 7) introduced compensation for vehicle or property damage against an unidentified vehicle where there are significant personal injuries arising from the same accident. In certain circumstances an excess may apply to vehicle/property damage claims. [/FONT]
 
Are you certain the driver was uninsured?

The fact that he/she was driving unaccompanied on a learner permit would not necessarily invalidate the insurance- if there was a policy in place.
 
One option is to talk to the Gardai about it. They'll no doubt have put the driver on notice that he's facing some serious consequences over this, and he could lessen these, and possibly convince them to proceed no further if he fully compensates you in advance, voluntarily. See what they say, and if they feel this is an option they're thinking of extending to the driver.

I wouldn't necessarily take the guards word for that. They, like Noel Brett, of the RSA did at one point, could be assuming because they were a learner on their own they are not insured. Which isn't the case. So go back and get the details of the insurer from the driver.
 
Sue the uninsured driver for the damage.
Bad idea, wrong move, expensive option and as others have said no guarantee of money at the end of the process.

Pursue MIBI claim and let them recover from the driver if they can. The MIBI exists precisely for the circumstances OP is in.
