Hi

Just trying to understand the process for setting up a new partnership. I have gone to the core website and they give the following question:
Presenter Type?
The following are the allowable answers:
(1) Irish registered company
(2) Business name registered in Ireland
(3) Irish resident individual
(4) CRO registered client

In my case I am trying to setup a partnership with a family member, so just trying to understand which option from the above we should select. I am currently PAYE and my business partner is self-employed(not sure if this matters).

"Presenter" is the person who files or lodges documents with the CRO. This information is only used if the CRO wish to contact someone in relation to the documents of there is any errors on them. You as a person or an accountant if they prepare them can put their contact details in the Presenter field.

If you are presenting the business resigtration form yourself on behalf of the partnership you insert (3) Irish Resident Individual if this applies.

To set up a partnership you need to submit a form TR1 to revenue. The CRO is only if you want to register a business name for the partnership.

If you want to set up a Limited company then you need to submit a form A1 to the CRO however you would probably need to hire someone to do this for you.

-Just one further question, would you typically submit the TR1 form to revenue before contacting CRO or the other way round.I take it you would only want to register a business name with CRO if the business is not going to take the name of the 2 people involved in the partnership, i.e. John SMith and Paul Jones are in partnership but they want to call their business - Golfing Holidays

The only compulsory obligation is to submit the TR1 to revenue, the CRO do not get a copy of this. Registration of a business name is optional but many people do because if they want to open a business account the bank will request one, plus they think it gives them a certain amount of protection with their name/brand, it's also very inexpensive at €20.

Once you submit a TR1 to revenue you've met your registration requirements.

Registration of a business name is obligatory if any individual or partnership (whether composed of individuals or bodies corporate or any combination of both) or any body corporate carries on business under a name other than their own true names. Its purpose is to make public the identities of those individual(s), partnerships or corporate bodies being the legal entity behind the business name.
 
censuspro, your post implies that the registration of a business name is optional, you even state this yourself. The registration of a business name is compulsary except in the case where a person or persons carry out business in a name which is their own true name (or names).

I outlined this clearly in my post!
