Following a recent thread it became apparent that this new legislation was being implemented in and around Ireland, but few people seemed in a position to comment on it, how it works or the implications for people in gainful employment here if a warrant has been issued for their arrest.

Where an employer becomes aware that a European Arrest Warrant has issued for one of their employees, a balance must be struck between said employee's right to privacy and the rights of the rest of the employees to enjoy and the duty of the employer to provide a safe place of work.

A useful course of action may be for the employer to take advice from a solicitor well-versed in both this emerging body of Criminal Law and Irish and European Employment Law as to how to best address this.
