If a court grants a judgement against an individual (over 6 years ago now) but the debt was never registered (ie- it's not showing up on a search for judgments etc), does the statute of limitations of 6 years still apply or is it still 12 years?

Thanks

N

The judgment lasts for 12 years.

The Statute of Limitations relates only to the period of time ( 6 years) that a creditor has to institute proceedings against a debtor from the date the debt accrues.

Ok thanks MF, Would you care to hazard a guess as to why the bank hasn't registered the debt after going to the trouble (and expense) of getting it? (It's for a big enough sum)

Thanks.

The OPs question is how long after obtaining judgement the creditor have to register that judgement.

Does anyone know.

"Does anyone know."

Yes - its 12 years from the date of the judgment.

There are a number of ways of enforcing a judgment - registering it makes it public knowledge and not all creditors want to alert other creditors to the debtors difficulties.

Or they've forgotten about it? Has been known to happen.
