Retention application-- site ownership

When a development is completed without the developer applying for planning permission and the developer is now forced to apply for retention of the same, what are the consequences for this same developer when the proof is provided that they don't have ownership of the site in question and will not be given permission under any circumstances to allow the local authority consider their retention application?
