Hi,

Can anyone help? Just been made redundant but owed a couple of months salary (plus leave days) - what steps do I need to take to ensure I get paid my owed salary ?

Can a company make me redundant, not backpay me and also continue to trade?

I'm not entitled to any redundancy payments but really need the couple of months salary.

Thanks

No you are entitled to all your pay. You would usually be first in the line of creditors as well if the company stopped trading. Have you talked to the company? If not, talk to citizens advice or something to see what your rights are.

The company must pay you your backpay and pay in lieu of notice etc.

If they don't, you can go to the Labour Relations Commission to get it paid.

The Department of Enterprise Trade and Employment has an Insolvency Payment Scheme which will pay you up to 8 weeks pay up to a ceiling of €600 per week.
It covers arrears of pay, holiday pay and pay in lieu of notice.

However, the company has to become insolvent for you to be covered by this.
