If a family home is in the name of one spouse and it is transferred into the name of the other is there stamp duty implications? I know there won't be gift tax due, and I know that there would be no stamp duty if it was being transferred into both their names, but what if one is transferring the entire property to the other? Having no luck on the Revenue website tracking down an answer. I know ye are probably wondering why someone would do this but their personal circumstances which are making this transfer seem like an option to be considered
 
Unless you will be subject to a clawback of some stamp duty relief (eg first time buyer) because the transfer is made within the required holding period, no stamp duty is payable on transfers between spouses.
