Hi,
Widower dies, leaves house to Adult Child A, splits other estate (mostly cash) among Adult Child A, Adult Child B, Adult Child C.
Can B & C contest the will with regards to not getting a portion of the house left to them?

Ages and Situations of the 3 children:
-Child A 48, last person to leave the house.
-Child B 54, married with her own kids and house.
-Child C, 60 not married, has own house.

Thanks in advance.

Regards

Ian

Yes you can contest the will, but it will be divisive, is it worth it, maybe the last child needs more than the others and the parents wanted it that way, it is their wish after all. Contesting something costs, and that will come from the estate (in general), thereby reducing it.

Please really think it through before you act.

I was reading it that the OP was possibly Child A in the scenario outlined and seeking comfort in their position...

Ah no I'm not any of the children. Trying to make child B see sense though and not to bother contesting it.

I can never understand contested wills. If the person making the will does it of his/her own free will and with a healthy mind, then clearly this is what they want and nobody should over-rule it.
