Can you use letters headed Private & confidential as evidence in a case?

The letters were not sent to me but were handed to me by the recipient to use as I wish.
 
Not sure, but I'm sure someone here will clarify.
I think that anything marked "Without Prejudice" cannot be used as evidence. (or anything subject to "legal privilege")
Also I think you have to submit the evidence before the hearing? (i.e. give the other party notice of it)
I could be wrong...
Perhaps someone more knowledgeable could clarify?
