Story background:
About 30 yrs ago, my aunt was married in El Salvador, she ended her relationship with her ex-husband , but never officially divorced. they verbally agreed to end the relationship but no paperwork was ever filed.
She moved to the US and met another man. She lived with him for many years but they were never married. Before he died he gave her about $30K . She used that money to buy a house in Palo Alto . Lately, She has been in talks with her ex-husband, and wants to make their divorce official. He found out about the money she received and wants half of it as a settlement for the divorce.
My question
Does he have a claim to her money if it was given to her as a gift??
In terms of tax or accounting or law
if Money is given to someone, as a gift, does that money belong to the married couple or to the person that it was given to?
can a spouse claim to own part of a cash gift given to the other spouse?
Could you shed some light on this matter?

Thank you ,

Obando; This is an Irish Republic based website so I doubt few or anyone here can help in terms of US or Californian legal and tax advice.
