My parents died in 2010 and 2014
Both left wills but did not go to probate .My parents signed over the family home to my sister in 2001
I have a brother who has special needs and was not contacted regarding the wills
What rights does he to pursue to see our parents last will.

There may have been no assets in either's estates that needed Probate.

There may be no assets.

Your brother may not have been provided for.

Your brother needs to take legal advice to see if he has any grounds/prospect to bring a Section 117 application.

Is your sister, who got the family home, the executor by any chance?

Has anyone approached the executor of either will?

Any chance of a family meeting? What ages are the surviving offspring? Any reason you can think of that brother not provided for?

I got in touch with the solicitor and he said there was a will and the executor would be in touch if we were in the will . He would not tell me who the executor is
So don't know where to turn to help my brother we could not afford to pay a court case any other advice would be welcomed
 
Contact a solicitor, normally the first consultation is free. While children are not automatically entitled to be provided for, it is my understanding that this is different when it comes to a child with special needs.
