Who should hold the deeds?

I bought my house in 2001 and was planning a top up my mortgage this year but my Bank tells me that they do not have the deeds and say the solicitor still holds them. The problem now is my solicitor is not answering my emails,calls or messages.

Can I tell my Bank to find the deeds or force the solicitor to find them as these are surely the responsibility of the Bank to retain.

You should write to your solicitor and give seven days for him\her to give you a resonse. If your deeds are languishing on a file, they should be returned to the lender within a specificed timeframe. If, as can sometimes happen, there is some problem or delay such that your title has not yet been registered, you should receive a full and detailed explanation and a timeframe for resolution. Otherwise, get another solicitor or consult the law society.
 
I had a similiar situation ( bought in 96) and I contacted the law society. Very long story, had to hire a new solictor to act for me, the law society handed over all my old solicitors files to a new firm and I had to pay to get everything done ( conveyanicing) as if I'd just bought the house. He'd done nothing!!! Now am filling out a claim form provided by the law society for €3000 in legal fees. They will pay it unless they go bust :mad:.

If your solicitor is AWOL don't wait, contact the law society today and they will chase him for you. It is not the bank's responsibility, it was your solictors to hand them over once conveyancing is complete. My bank didn't even think it was that odd at the time ( 2 years ago). They are probably taking a bigger interest nowadays
 
Thank you. this is very helpful. I had the same problems with getting the property registered. The property was never registered and I only managed to get this done last year with a struggle. so yes I will put pen to paper now as email and phone is a waste of time.

Actually phoning the Law Society does work as you will probably find they are already aware there is a problem. Send a letter too though if it makes you feel better. Best of luck.
