I am so upset cos I didnt register letter...what can I do now

You don't need to be too upset, whatever the outcome.

The Appeals Panel rejected 95 out of 96 appeals so far. So I suspect that they won't even read the the responses.

It's worth sending them in on time, but it's not a crisis if they claim you were late.

Thanks for responding Brendan I suppose Im upset because I wanted appeal dealt with by Aib initially rather than tracker panel. They have forwarded it so will just wait now. Lesson learnt will register post from now on. Money is so tight even paying to register a letter was too much, I hate what Aib has done to me
 
BDO got back to me very quickly to say my appeal was now with the Panel for further review 'since no response has been submitted'. I rang them to let them know that I had responded within the time frame. When they looked up my file they said they had received my response and that it was being considered. I might ring them again to get a letter acknowledging this.
 
Also as I did post in my appeal on 28th April should I ring them to have it on record that they should have received it before 7th May and to query how they can write out a letter dated 7th May when surely I should have had until close of business on 7th May for my response to get to them

AIB does not deal with the appeals. Only the Appeals Panel deals with them.

But the Appeals Panel sends the appeals to AIB for their comment.

So you have not lost out at all.

Hi Brendan,
Just wanted to clarify before our appeal to AIBs response. we took our mortgage offer on Dec 2008, which is after Oct 2008 when they claim to have stopped tracker . Does this mean we are a little late to have been given the prevailing tracker rate? But if so then why did they compensate us last year (€1615.00)?

Whats the date on your letter of offer? Do you have the 3.2 clause in your contract?

This is the only relevant issue.

You had this clause or else you would not have received the €1,615.

Did AIB say anything specific about the date you took out the mortgage being after October 2008? Or did you get the same response as everyone else?

Thats right Brendan, the confusion we have is that they reimbursed us (€1615.00)with the service failure letter but now in their response, they state that as our letter of offer was jan'09 , we were not eligible for prevailing tracker rate.
however, in their compensation letter from last year they accepted the fact that we were eligible for choosing from variable, fixed or tracker rates after we come off our 1 year fixed term.
we have decided to send them another response anyways.

I was away with work for three weeks and only now have used your draft to reply and am due to post it tomorrow. I'm now outside the 10 working day reply time frame. Is it still worth sending it in. I intend to phone BDO and explain the delay?

Just received today letter from BDO AIB have not yet considered my case and the 10 day bla bla every communication I had with them aswell I will reply as per draft sorry can you post again please
 
Has anyone else still not received an initial reply yet? We sent in our appeal in early March, and got a letter on 24 April from BDO saying our appeal was still receiving attention and is currently with the Bank for review. Nothing since. It seems like a lot of people here have heard back and had their appeal rejected, so just wondering if many others are still waiting to hear?

A lot of people using the pro forma appeal received a response from AIB
They have not yet had their appeal rejected by the Appeals Panel yet as far as I know.
They received a response from AIB and they responded to that response, but that is as far as anyone has gone based on the pro forma.

Of course, a lot of people who submitted appeals earlier have had their case determined by the Appeals Panel.

There is no need at all to worry as there is no hurry.

The Appeals Panel requires AIB to photocopy everything on the person's file, so this takes a long time. I understand that there was a rush of appeals lodged in the final week so these would be delayed even further.

Thanks Brendan, that's reassuring. We have not received the response that requires people to reply within 10 days- I just wanted to make sure I hadn't missed the boat on that.

Just to clarify- we did also use the pro forma appeal, amended slightly to detail notes from a meeting with AIB in 2010. At this point we paid to break our fixed rate and sought to go on a tracker, which was obviously denied. I suppose I was wondering if this detail might be delaying their response to us, because we haven't received anything apart from the letter saying it's with the bank for review, or are we just part of the backlog.
