What is the ethical thing to do when building a Retention wall between gardens

I want to create a split level garden on our currnetly sloping back garden.
i need to build a retainer wall to keep the soil in. At the moment there is only a wire sheep fence between us and the neighbours garden as we are out the country.

What should I do before building the retainer wall to create the split level garden? Are there any legal requirements here?

I would think that if you just make certain that you know where your property ends and your neighbour's begins, and build the wall entirely on your own property, then there should be no complications whatsoever.

Also, talk to your neighbour beforehand and let them know what you propose to do, good communication can stop any problems which may arise and the other party can't get miffed at a structure appearing overnight as such.
