hey everyone,
sorry for opening a new thread thats similar to my other thread "deposit for vendor" but i feel i've a whole new bag of issues.
After paying my old solicitor 320 euro to leave him and change solicitors, my new solicitor still hasn't recieved documents!
I paid the old solicitor on the 29th april after recieving a bill from him dated the 24th. This is a quote from said letter "I enclose a note of my fees to date please arrange to discharge upon receipt of same I will arrange to forward all documentation and file to your new solicitor"
So as usual everything has come to a complete stand still.
So my question is where do I go from here? my new solicitor hands seem to be tied except regularly phoning the vendors solicitor.
I cant say for sure that my old solicitor has the documents but i'm pretty sure he does.
I phoned the old solicitor this morning telling him that i was reviewing reciepts and could he tell me what date he sent documents after i paid him? His response "I'm no longer your solicitor, you should discuss it with your new solicitor"
Then he hung up on me!
I'm really at my wits end, we just want to get moving.
Any advice greatly appreciated, I'm so stressed!

It would appear that your new solicitor needs to write to the old solicitor stating that s/he now represents you and requesting the old solicitor to forward documentation, if that hasn't happened already.

He may be your old solicitor but he hasn't discharged his duties.. his last action on your behalf is to send the documents.. report him to the appropriate body.. tell them he is bringing the profession into disrepute.

Also if it was me I would be turning up in person.. at his business, possibly at his house too but I can't really recommend that!

I'd say he will send the documents eventually.

thanks for the replies,
just out of interest who is the appropriate body to complain too?
My own solicitor is really doing her best by hounding the vendors solicitor. I'm just relly stressed out about it, what if our mortgage approval runs out and we're back to square one?
I think its a disgusting way to treat a FTB who doesn't know the system.
Does anyone else think i should call to his office or should i leave it in the hands of my solicitor? 3 weeks has been a hell of a long time, how much longer should i wait?

Just an update for ye,
New solicitor phones this afternoon to say the "missing documents" landed on her desk this afternoon. So the worry is over thank god. I hope it will run smoothly from now on. Thanks for all the advice
